Shielding Metadata in Discovery
New article by Randall Farrar published in The Recorder.
"Those of us in the legal profession are familiar with the concept of "discovery," and the requirements set by the courts for complying with discovery demands. We also know that we are only required to provide the documents and data information set out in the discovery demand. Unfortunately, in providing electronic documents, you may "discover" that you are inadvertently disclosing more information than you realize".

Letter from Esquire CEO on Microsoft Patent Infringement
The feature in question is custom XML elements contained within DOCX or DOCM document types. iCreate 7's use of Content Controls are not in conflict as they are mapped to custom XML parts. The method used in iCreate 7 is the technology actually recommended by Microsoft, not the method found in violation of the patent.
Our development team will re-test all products as Microsoft makes patches and/or new versions available.

New Massachusetts Law on Protecting Client Information
Interesting New Law in Massachusetts: MA 201 CRM 17 Standards for The Protection of Personal Information of Residents of the Commonwealth
Goes into effect on May 1, 2009. This new compliance regulation will require that companies doing business with Massachusetts residents comply with stringent data protection requirements. Every company, business partner and service provider that owns, licenses, stores, handles and/or maintains personal information about a resident of Massachusetts will need to meet set standards for protecting personal information of Massachusetts residents - whether that business is located in MA or not. Sounds like they need iScrub to help them manage the metadata in their documents.

Where Do the Footprints of Metadata Lead?
Interesting Article on metadata featured on Law.com February 20, 2008, by Marcia Coyle
"We may still not know enough about e-mail, Word documents, Excel spreadsheets, to really safely use them," states Lucian Pera of Adams & Reece. "But lawyers are going to have to understand the technology they use or they won't be competent in practicing law or protecting their confidential info. That's why you have to know what a metadata scrubber is."

Recently I?ve taken a position with a large firm based in Houston, Texas. Of course large firms bring challenges along with opportunities when it comes to legal technology. One of the more encouraging pieces of technology I?ve seen here in my first few weeks is called iScrub from Esquire Innovations. In addition to being a worthy metadata removal tool, I have come to appreciate our firm?s implementation of the product.
